Osmanlı taşrasında bir memurun hukuk mücadelesi: Yabanabad Reji memuru Zekeriya Sırrı Efendi davası

Abstract

Osmanlı Devleti’nde tütün imtiyazını üstlenen Reji Şirketine bağlı Ankara Reji İdaresi bünyesinde teşkilatlanan Yabanabad Reji Memurluğu incelenerek hazırlanan bu çalışmanın amacı, memur Zekeriya Sırrı Efendi’nin zimmet davası sürecini ele almaktır. Bu doğrultuda dava sürecinin hangi merhalelerden oluştuğu ve davanın nasıl sonuçlandığı saptanmaya çalışılmıştır. Bu çerçevede çalışmanın giriş kısmında Yabanabad kâzasının idari statüsü ve Osmanlı’da tütün denetiminin Reji Şirketine devredilme süreci hakkında bilgi verilmiştir. Daha sonra Yabanabad Reji Memurluğunun kuruluş süreci, faaliyetleri ve personeli konularına değinilmiştir. Ana metinde bu personellerden biri olan Zekeriya Efendi hakkında 1910-1912 yılları arasında cereyan eden zimmet davası ele alınmıştır. Bu değerlendirme sürecinde ana kaynak olarak istifade edilen arşiv belgelerinin yanısıra literatürde yer alan araştırma inceleme eserlerden de yararlanılmıştır. Bu bağlamda Yabanabad Reji Memurluğunda Zekeriya Efendi ile ilgili meydana gelen şikâyetlerin aslının olup olmadığı ortaya çıkarılmaya çalışılmıştır. Netice olarak, Zekeriya Efendi hakkında yapılan şikâyetlerin doğru olduğu ve şirket kasasından zimmetine 10.672 kuruş 82 para geçirdiği saptanmıştır.

The purpose of this study, which was conducted by inspecting the Yabanabad Regie Office organized under the Ankara Regie Administration of the Regie Company, which assumed the tobacco franchisein the Ottoman Empire, is to address the process of the embezzlement lawsuit of Officer Zekeriya Efendi. To this end, it is intended to determine the stages of the lawsuit process and how the lawsuitwas concluded. Accordingly, the introduction of the study provides brief information about the administrative status of Yabanabad District and the process of transferring the control of tobacco to the Regie Company in the Ottoman Empire. Then, the establishment process, activities, andpersonnel of the Yabanabad Regie Office are discussed. The main text discusses the embezzlementcase against one of these personnel, Zekeriya Sırrı Efendi, which took place between 1910 and 1912. In this evaluation process, archival documents, which were used as the main source, as well asresearch and review works in the literature were also utilized. To this end, it was endeavored to findout whether the complaints filed against Zekeriya Efendi at the Yabanabad Regie Office were genuine or not. In conclusion, it was concluded that the complaints made against Zekeriya Efendi were true and that he embezzled 10,673 kurush 82 coins from the company coffers.
