Abstract
Zeydilik, Irak bölgesinde doğup ilk devletini Taberistan’da kurmuş ve bu bölgede İslâm dinini temsil eder olmuştur. Kuruluş sürecinde Zeydiler Mu‘tezile ve Hanefîlikgibi pek çok mezheple etkileşim halinde olmuşlardır. Bu etkileşimle beraber yetişen önemli fakihlerin katkılarıyla Zeydi fıkhı gelişmiş ve sistematik bir hal almıştır. Bu fakihlerden biri de hicri 5. yüzyılda yaşamış Zeydi imam Nâtık-Bilhak’tır. Bu çalışmaya konu olan fakih, çok yönlü bir âlim olup önemli eserler kaleme almıştır. Bu eserler içinde en çok dikkati çekenlerden biri de fürû-i fıkıh alanında yazdığı et-Tahrîr’dir. Bu muhtasar eserinde Nâtık-Bilhak, kendinden önceki Zeydi imamların görüşlerine yer vermiş ve onları özlü bir biçimde aktarmıştır. Bu araştırmamızın amacı, adı geçen eseri üzerinden müellifin Zeydi fıkhındaki yerini ve önemini ortaya koymaktır. Yöntem olarak tabakat kitaplarından yararlanılarak müellifin hayatı ve onu etkileyen fakihler tanınmaya çalışılmış, ayrıca onun bize ulaşan eserleri hakkında genel bilgi verilmiştir. et-Tahrîr’in incelenmesinde örneklem olarak eserin Kitabu’l-buyû’ bölümü tercih edilmiştir.
Zaydism was born in the Iraq region and established its first state in Tabaristan and it came to represent the religion of Islam in this region. During the establishment process, Zaydis interacted with many sects such as Mu'tazila and Hanafism. With the contributions of important jurists who grew up with this interaction, Zaydi fiqh developed and became a systematic school. One of these jurists is the Zaydi imam al-Nāṭiḳ bi’l-Ḥaḳḳ, who lived in the 5th/11th century. This jurist, who is the subject of this study, was a versatile scholar and wrote important works. One of the most striking among these works is al-Tahrīr, which he wrote in the field of fiqh. In this concise work, al-Nāṭiḳ bi’l-Ḥaḳḳ included the views of the Zaydi imams before him and tried to convey them in a concise manner. The aim of this research is to reveal the author's place and importance in Zaydi jurisprudence through his mentioned work. As a method, the author's life and the jurists who influenced him were tried to be known by using modern and classical literary books, and general information was also given about his works that have come down to us. In examining al-Tahrīr in detail, the Kitab al-buyū' section was preferred as an example.
