Uluslararası hukukta iklim değişikliği nedeniyle göç ve koruma statüleri

Abstract

Bu çalışma küresel bir sorun olan iklim değişikliğinin olumsuz etkileri ile zorunlu göç arasındaki ilişkiyi incelemektedir. Bu bağlamda iklim değişikliğinin etkisiyle zorunlu olarak göç etmek zorunda kalan kişilere mevcut uluslararası hukuk çerçevesinde nasıl bir koruma sağlanması gerektiği konusunda çözüm yolları aranmıştır. Uluslararası göç ve sığınma hukuku, insan hakları hukuku ve çevre hukukunun birlikte ele alındığı bu çalışma üç bölümden oluşmaktadır. İlk bölümde uluslararası sığınma hukukunun kavramsal ve tarihsel gelişimine değinirken ikinci bölümde iklim değişikliği ile mücadeleye yönelik alınan önlemler uluslararası hukuk çerçevesinde değerlendirilerek iklim krizi ve göç arasındaki ilişki incelenmiştir. Yerel mahkeme kararları ile uluslararası mahkeme kararlarından yararlanılarak çalışmanın içeriği zenginleştirilmiştir. Nihayetinde iklim değişikliği nedeniyle göç etmek zorunda kalan yahut yakın bir gelecekte kalması beklenen kişilere uluslararası, bölgesel ve ulusal hukuk çerçevesinde tanınabilecek koruma statüleri ve çözüm önerileri üzerinde durulmuş ve çalışma sonuçlandırılmıştır.

This study examines the relationship between the negative effects of the global problem of climate change and forced migration. In this context, solutions have been sought for providing protection to individuals compelled to migrate due to the impact of climate change within the framework of existing international law. This study, which considers international immigration and refugee law, human rights law and environmental law together, consists of three parts. While the first part deals with the development of the concept of international immigration and refugee law in the historical process, the second part deals with the relationship between the climate crisis and migration is examined by discussing the international measures taken to address climate change within the framework of international law. The study's content has been enhanced by incorporating local court decisions as well as international court decisions. Finally, the study is concluded with the protection status and solution suggestions that can be provided within the framework of international, regional and national law to people who are forced to migrate due to climate change or who are expected to stay in the near future.
