Teknolojik iletişim araçları ile evde (tele) çalışan işçinin kişisel verilerinin korunması

Abstract

Son dönemlerde yaşanan teknolojik gelişmeler ile dünyada klasik anlamda iş ilişkilerinin yerini esnek istihdam türleri almaya başlamıştır. Tüm dünyayı etkisi altına alan Covid-19 Pandemisi sebebiyle bu istihdam türlerinden olan "uzaktan çalışma" oldukça yaygınlaşmıştır. İşçinin iş görme edimini işverenin işyeri dışında bir yerde ifa ettiği uzaktan çalışma, tele çalışma ve evden çalışma olmak üzere iki şekilde gerçekleştirilebilmektedir. İşçinin iş görme edimini teknolojik iletişim araçları ile kendi evinde yerine getirmesi halinde, iş ilişkisi evde teleçalışma olarak nitelendirilmektedir. Evde tele çalışan işçi, iş görme edimini işverenin doğrudan gözetimi ve denetimi altında bulunmaksızın yerine getirmektedir. İşveren ise, kendi evinde çalışan işçiyi izlemek ve denetlemek için elektronik izleme uygulamalarına başvurmaktadır. Elektronik izleme sonucunda, işçinin kişisel verileri işlenmektedir. Evde tele çalışma ilişkisinde tarafların borçları kural olarak klasik anlamda iş ilişkisindekinden farklı değildir. Bu sebeple, işveren evde tele çalışan işçinin kişisel verilerini korumakla yükümlüdür. Çalışmamızda, işçinin kişisel verilerinin korunmasına ilişkin temel esaslar açıklandıktan sonra evde tele çalışmada işverenin başvurduğu elektronik izleme uygulamalarının hukuka uygunluğu, yasal mevzuat, mahkeme kararları, karşılaştırmalı hukuk ve yabancı veri koruma otoriteleri tarafından verilen kararlar ışığında değerlendirilmeye ve bu uygulamaların hukuka uygun bir şekilde gerçekleştirilmesi için dikkat edilmesi gereken hususlar ortaya konulmaya çalışılmıştır.

Due to recent technological developments, flexible forms of employment have started to replace classical employment relations in the world. Due to the Covid-19 Pandemic, which has affected the whole world, "remote working", one of these types of employment, has become quite widespread. Remote working, in which the employee performs his/her work at a place other than the employer's workplace, can be carried out in two ways: teleworking and working from home. If the employee performs his/her employment obligation at his/her own home through technological communication tools, the employment relationship will be defined as tele-homeworking. The tele-homeworker performs his/her work without being under the direct control and monitoring of the employer. Meanwhile, the employer uses electronic surveillance applications to control and monitor the tele-homeworker. Electronic surveillance results in the processing of the personal data of the worker. The obligations of the parties in a tele-homeworking relationship are, as a rule, not different from the classical employment relationship. Therefore, the employer is obliged to protect the personal data of the tele-homeworker. In our study, after explaining the basic principles regarding the protection of the personal data of the employee, the lawfulness of the electronic surveillance practices used by the employer in tele-homeworking has been evaluated in the light of legal legislation, court decisions, comparative law and foreign data protection authorities' decisions, and the issues to be considered in order to carry out these practices in accordance with the law have been tried to be outlined.
